We comply with the federal Telephone Consumer Protection Act (TCPA) and applicable Florida telemarketing laws (Florida Statute § 501.059). Specifically:

  • We will only send you SMS text messages if you have provided prior express written consent

  • Message and data rates may apply
  • We do not use automated telephone dialing systems or pre-recorded voice messages for marketing purposes without consent
Note: If you are an active client, you may receive automated SMS notifications related to lead activity through our CRM system. These are service-related communications and are governed by your service agreement.

11. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, to comply with applicable legal obligations, resolve disputes, and enforce our agreements. Our general retention periods are:

  • Inquiry submissions (non-clients): Up to 3 years from the date of submission
  • Active client records: Duration of the service engagement plus 5 years following termination, as required for tax and accounting purposes under Florida and federal law
  • Email correspondence: Up to 3 years
  • Website analytics data: Subject to Google Analytics default retention settings (up to 26 months)

When data is no longer required, it is securely deleted or anonymized. You may request early deletion of your personal information subject to legal retention requirements (see Section 13).

12. Data Security

We implement industry-standard technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include:

14. Notice to Florida Residents

Florida residents have specific rights under Florida law, including the Florida Information Protection Act (FIPA), Fla. Stat. § 501.171, and the Florida Digital Bill of Rights (FDBR), Fla. Stat. § 501.701 et seq. (effective July 1, 2023, for covered entities).

FootPrint Digital Solutions is a small business and does not meet the revenue or data processing thresholds that trigger mandatory compliance with the FDBR as a "controller." However, we voluntarily extend the following rights to all Florida residents as a matter of best practice:

  • The right to know what personal data we collect about you and how it is used
  • The right to request deletion of personal data we have collected
  • The right to opt out of the sale or sharing of your personal data (we do not sell or share personal data)

15. Children's Privacy — COPPA Compliance

Our Site and services are directed exclusively at businesses and business owners who are at least 18 years of age. We do not knowingly collect personal information from children under the age of 13, as defined by the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501–6506.
